In short
- We only collect what you send us through the contact form, and we use it to reply.
- No analytics, no advertising and no tracking cookies. Fonts and images come from our own server.
- To keep spam out, the form uses a bot check from Cloudflare and short-lived limits on how often messages can be sent.
- Your message reaches our inbox through Resend, an email delivery service.
- You can ask us at any time what we hold about you, or to delete it: martinsofcik@gmail.com.
1. Who is responsible for your data
The controller of your personal data is MartinSoft, Stanisława Taczaka 24/103, 61-819 Poznań, Poland, NIP 7642436375.
For anything about your data, write to martinsofcik@gmail.com or by post to the address above.
2. What we process, why and for how long
2.1 Messages from the contact form
- What
- Your name, email address, optionally your company, the topic you pick and your message.
- Why
- To read your message, reply to it and carry on the conversation you started.
- Legal basis
- Our legitimate interest in answering the people who write to us (art. 6(1)(f) GDPR). When you ask about working with us, also steps taken at your request before a contract (art. 6(1)(b) GDPR).
- How long
- For as long as the conversation needs, then up to 2 years in case you come back to it, unless the law requires us to keep it longer, for example when the conversation leads to a contract.
2.2 Protecting the form from spam and abuse
- What
- Your IP address, the email address you enter, when you send messages, and a one-way fingerprint of the message that lets us recognise the same message sent twice without keeping its text.
- Why
- To stop automated spam and floods of messages, and to avoid sending the same message twice.
- Legal basis
- Our legitimate interest in keeping this website and our inbox secure (art. 6(1)(f) GDPR).
- How long
- At most 24 hours, only in the working memory of our server. It is not written to disk.
2.3 The bot check (Cloudflare Turnstile)
When you get close to the contact form, your browser loads Cloudflare Turnstile, which checks that a person is using the form. For this Cloudflare processes your IP address, your browser's user agent and technical features of the connection (a TLS fingerprint). Turnstile does not read what you type into the form.
Cloudflare processes this data for us, and also as an independent controller to improve its bot detection. The legal basis on our side is our legitimate interest in protecting the form from bots (art. 6(1)(f) GDPR). Details are in Cloudflare's Turnstile privacy addendum.
2.4 Visiting the website
When you open any page, the server receives the technical data needed to deliver it: your IP address, browser type, the page requested and the time. We use it only to keep the site running and secure (art. 6(1)(f) GDPR), and server logs are deleted after at most 30 days.
3. Who else receives your data
We do not sell your data or share it for advertising. It reaches only the companies that help us run this site, which process it on our behalf under data processing agreements:
- Resend, Inc. (USA), which delivers messages from the contact form to our inbox;
- Cloudflare, Inc. (USA), which runs the bot check described in section 2.3;
- our hosting provider, which runs the server this site is on;
- our email provider, which hosts the inbox your message arrives in.
We may also have to share data with public authorities when the law requires it.
4. Transfers outside the European Economic Area
Resend and Cloudflare are based in the United States and store data there. Both are certified under the EU-U.S. Data Privacy Framework, which the European Commission recognises as ensuring an adequate level of protection, and their transfers are also covered by the Commission's standard contractual clauses. You can ask us for a copy of these safeguards.
5. Cookies and tracking
This website sets no cookies of its own and uses no analytics, advertising or social media trackers. Fonts and images are served from our own server. The only outside service is the Cloudflare bot check near the contact form, which runs in a frame served by Cloudflare as described in section 2.3; see also Cloudflare'scookie policy.
6. Your rights
Under the GDPR you have the right to:
- know whether we process your data and get a copy of it;
- have it corrected if it is wrong or incomplete;
- have it deleted, or its use restricted;
- receive it in a portable format, where we process it to take steps towards a contract;
- object at any time to processing based on our legitimate interest, for reasons relating to your situation;
- lodge a complaint with the supervisory authority: in Poland, the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warszawa,uodo.gov.pl.
To use any of these rights, write to martinsofcik@gmail.com. We reply within one month.
7. Do you have to give us your data?
No. Writing to us is up to you. Without your name and email address we cannot reply, so the form asks for them. You can also simply email us at martinsofcik@gmail.com.
8. Automated decisions
We do not make decisions about you based solely on automated processing that have legal or similarly significant effects. The bot check is automatic, but all it decides is whether the form accepts a message; you can always email us instead.
9. Links to other websites
Our pages link to other websites, such as notiqer.com. Each of them has its own privacy policy.
10. Changes to this policy
When we change how we handle data, we update this page and the date at the top.
